>> ian was shocked that a 17-year-old lifeguard would bite him. his mother said she tried to talk to supervisors at recreation and parks and gave her the run around. now she is afraid he may have terrorized other kids that are too scared to speak up. >> me and smi friends were playing, and we made a house out of foam. >> ian was playing here at the aquatic center in northwest baltimore, july 31. >> then the lifeguard came upstairs, and he messed up our little house. so i went over there and smacked him in the arm. >> he says that 17-year-old lifeguard retaliateed. >> then he picked me up and bit me. >> leaving marks two weeks later. >> it was like having your arm punched together by two rocks very hard. and it just made me want to cry so much. it was so painful. >> i was upset.

>> his mother alycia approached the teen. >> he said well i always play with the kids. and i said aren't you supposed to be in the pool? why would you bite him. well he bit me. he pointed to his hand and i look at it and saw nothing. >> she rushed him to the hospital. the diagnosis, a human bite. afterwards she filed a report with the department of juvenile services and what she learned there was shocking. >> she said he was on probation. doubt on he would lessen it. so going to make him write a letter of apology. >> the department of recreation and parks said the case is under investigation and every employee working with children undergoes fingerprinting and background check. and released this statement. an offense does not preclude you from working in the department. >> it could have been so much worse on. and if that's his attitude that it is no big deal. then maybe he should not be working with kids. >> it is not a very good thing to do to a 9-year-old, because because he is a little younger than you, and you are almost a

full grown adult. i mean, like, you are messing with a 9-year-old kid. i don't think that's right. >> while the case is under investigation the 17-year-old lifeguard is still working at the aquatic center. karen parks, fox 45 news at 10:00. >> the parade of town halls on health care reform continues today. democratic senator arrest lan specter of pennsylvania held his fourth townhall in three days. this one about a hour northeast of pittsburg. >> everybody that has a private plan can keep the private plan that they have if they want to keep it. >> and that's the reaction he got. minutes into the townhall meeting. majority of the audience was against many of the reform proposals. >> freshman representative mike kaufman faced a crowd in littleton colorado earlier today.

>> the republican congressman said he agrees with many of president obama's points but he is concerned about the cost of health care reform. and he also oppose the public auction. kaufman said he would introduce an amendment to require lawmakers to use the public option, if it passes. that brought a big applause from the crowd. >> residents of oklahoma were able to voice their concerns it to a lawmaker today too. >> i am an unemployed rural oklahoman. what can i do to change that if it gets crammed down my throat? or before it is crammed down my throat? >> republican senator colburn listened to a crowd in tulsa. hundreds showed up there. many in the crowd were worried about government control. colburn said health care reform is needed but not president obama's plan. the tough townhall debates over health care seem to be hurting president obama's popularity. according to an average of the approval polls, 53 percent

approve of the job he is doing now. 40 percent disapprove. obama's approval rating is as low as 47 percent in one poll. now the effect of the protest at townhall meetings appears to be mixed. gallop poll showed 34 percent of americansed the townhall meetings have made them more sympathetic to the protestors, and (inaudible) 36 percent, however, say that all the yelling has not made a bit of a difference. >> down to the question of the day. have the townhall protests made you more sympathetic with the views of the protestors? a 43 percent say more. 36 percent say less. 21bers say they have made no difference at all. >> as people go to these get-togethers, they bring their anger with them, of course. but why are so many townhall meetings getting out of hand. jeff abell reports on what has little to do with health care reform. >> if we don't get health care costs under control, our

cardin on our website. log onto foxbaltimore.com and click on "raw news". >> well, the white house said it is trying to push back against what it calls misinformation about health care reform. the administration has created a website to get the message across. and today, it started a viral e-mail campaign. >> one of the reasons we have pushed back is because of the misconceptions. some of the misconceptions contributed to the poll numbers? i don't doubt that. >> the president has two more town halls this week. >> all the noise over health care has completely overshadowed the actual facts of the plan. president barack obama has said if you like your doctor, keep your doctor. he says the same goes for your health care plan. bill adare from politifact.com said in theory that is true but there are still concerns. >> given that this will dramatically change the marketplace of health care insurance. we don't know if any given health insurance will be offered the same way in a few years. >> on the issue of rationing meantime adare said private

>> closer look at the case against a teenager accused of shooting a 5-year-old girl. what do gps records show? and will video of the shooting actually help or on hurt the state's case. reporter joy lepola has the latest tonight. >> as attorneys on both sides build their cases, evidence is beginning to mount. just days ago video of the shootings was released. questions now center around whether the person seen here pulling the trigger is 17-year-old lamont davis. a juvenile under gps monitoring at the time. >> there is a resident zone set up. >> in an interview fox 45 news sat down with a representative from i secure track, the company that supplies and monitors gps devices for the state of maryland. >> this device is worn around the ankle. personal tracking unit is

carried with the youth. >> gps records released wednesday by the department of juvenile services indicate davis was in compliance at the time of the shootings. some sources suggesting records show davis was at home around 4:00 on july 2. when 5-year-old raven wyatt was shot. >> as long as they have the units we can tell where they are at. and we can tell when a crime is commit. >> but even the company admits the tracking is not full proof. >> there are ways that you can get around the tracking of a one piece unit. just are there are ways to try to thwart the system. >> besides gps records there is the video from the cameras that both sides will likely reference. but whose case does it help the most? numbers show the state has dismissed hundreds of cases in which the footage was included as evidence. >> davis' attorney said the video proves the shooter is not wearing a gps ang let. >> it is certainly not a slam

dunk. >> last year alone, prosecutors dismissed nearly 500 cases, where the pole camera footage was used as evidence. >> what it shows is that there are so many other factors that contribute to a successful prosecution. the evidence, the witnesses, the time line, the police officer. all of that is very valuable to a successful prosecution. >> as for the role the evidence will play in davis' case that will be up to a jury to decide. in downtown baltimore, joy lepola fox 45 news at 10:00. >> as of tonight davis goes to trial october 2. >> new evidence shows what happened when the driver of a truck hit and killed a man riding his bike near charles village last week. memorial at the intersection where john gates was hit and killed. and an attorney for the yates's family said surveillance that has not been released said the truck took a right turn without a signal and caused the crash. the video however does not show the license plate or any other

identifying marks on the truck. >> a judge in charles county resigns after an incident near a courthouse in l.a. la plate ta. he admits he let the air out of a rear tire of a car in front of courthouse. the judge said someone was parking in a restricted zone and left notes for the driver. and said deflating the tires was less of a hassle than having is the car ticketed or towed. the driver said she never received a note or a warning. >> in less than two weeks, state of maryland will slash its budget by $400 million. but this week, hundreds of state and county officials are gathering for a big convention in ocean city. it features a crab feast and private receptions, and in some cases, tax payers are picking up the tab. we have more from ocean city. >> while there are spouses and families enjoy the beaches and boardwalk, hundreds of state is

officials descend on the convention center. it is the annual maryland association of county's convention and it is a must for governors, lieutenant governors, members of congress, and baltimore's mayor. >> to be able to have time, one-on-one, in small groups, to really discuss some of the challenges and issues that we face, in good times and in bad. >> and the theme of the congruence? riding the economic cycle. there are workshops seminars on how government can do more with less. but in many cases, your tax dollars are paying for those attending. >> many members of the general assembly are here. but registrations are paid for by maryland association of counties. and they are not allowed to be reimbursed by the state for hotel or other expenses. >> but most state and county bureaucrats are reimbursed for hotels and meals. >> we have to be given some flexibility in our own budget. to handle the cuts that the state feels they have to impose.

>> while governor o'malley is canceling his own reception to save money. mayor sheila dixon is still hosting a baltimore city reception. cast aways restaurant. a party paid for not with taxpayer dollars but a corporate done on nar. rice consulting. >> good way to network and relax for the evening. >> many time, the clarion hotel is where baltimore executive jim smith is hosting his own reception. a party he says is being paid for by campaign funds. >> i have had that party every year and no county funds have ever been spent on the party. >> because of the economic downturn, some county executives have decided to stay away from the maco conference. >> i think in these difficult financial times we need to use good judgment and not spend taxpayer money for such events. >> we should not short-circuit the sort of interactions, dialogues and sharing of best practices that happens here.

attendance is actually up this year over previous years. >> just steps away from inner harbour, business at the aquarium is booming. with attendance ranging anywhere from 5000 to 10,000 visitors a day. >> you get a great experience with a 2-year-old and an 80-year-old. >> helping to bring down that sparkle baltimore's inner harbor is used to. >> we hear a lot from people in baltimore that live here, when they bring friends from out of town and come down here, they will say "i forgot how great it is downtown." . >> we see about the same number in terms of a foot traffic this year. but they are not spending as much. >> what better way to keep the crowds coming than offering something for free. >> we have activity carts on the weekends. and a park right here by the aquarium and by the visitors center, with activities that kids can play with. so they can help to make dinosaur masks and jelly fish.

>> good evening folks. looking at a pretty decent evening after we had a day of heat and humidity. sun and clouds. and even a few showers and thunderstorms around the area. but that all subsided as we look live down toward m&t bank stadium. ravens taking on the redskins. battling on the gridiron down there. good night to get out to check out the game. 75 degrees. few high thin clouds. winds out of the east at eight. and humidity levels sitting at 83 percent. our temperatures today. not too bad across the area. in fact, cooling off at this time at 74 degrees in harrisburg. 77 in baltimore. and 73 in pittsburg.

down south of us in richmond 75. and start off the weekend pretty decent temperature wise. but there will be warmer temperatures building in as we round out toward the end of the weekend. getting the temperatures back in the it is 90s. we had the stationary front that was helping to lift the atmosphere. few pop-up showers and thunderstorms here and there across the region. in the mid-atlantic. further west you see on the western edge of the mountains. clear skies over ohio, michigan, indiana. looking good back there. and that's a little bit of the high pressure that starts to move in and that will join us for the weekend. giving us clearing. and drying condition. now as we time this out. you can see some of the pop up showers and thunderstorms moving and subsiding south, and mainly breaks in the clouds. relatively quiet conditions through the overnight. in fact, our model data here on the future scan shows tomorrow morning's rush hour, 6 a.m., plenty of sunshine. maybe morning fog to contend with. give yourself extra time. patchy fog across the baltimore, washington area. so be prepared for that. but as we go through the afternoon. most of the shower activity

south of us. 20 percent chance for a pop-up shower somewhere in the region. but it looks like the best chance will be south of us. west of us will get more clearing through the overnight. and it looks like a decent evening all and all. as far as the eastern shore. here is the forecast. we will see the temperatures at 84 degrees. winds out of the east at five to 10. for you folks in chestertown, denton, easton and cambridge. central portion of the state. temperatures doping out around 85. with easterly wind at five. 20 percent chance for a stray shower. pair he hall, annapolis, perry hall and westminster. decent. high pressure is building in. behind the front. as it continues to subside south. this high pressure will eliminate the chance for showers and thunderstorms as we get into the weekend. all the moisture will move down over parts of southern virginia. eastern portions of north carolina. and we will continue to see the moisture move out over the atlantic. and we will continue to enjoy the high pressure through the weekend. but it will bring warmer temperatures in toward sunday and monday. 85 degrees downtown inner harbour. pleasant day.
